When a person passes away and leaves behind assets and debt in their name, probate, is the legal process for distributing the assets and addressing all debt remaining in the estate. A part of the probate process is notifying the public, so that all potential creditors have adequate time to make claims against the estate, in order to attempt to redeem the claim.
The following are the steps for notifying creditors in North Carolina. Contact information for Durham county qualified publications is also provided.
How to complete the Notice to Creditors requirement for Probate NC:
- Contact the newspaper
- Share your Letters of Testamentary or Letters of Administration
- Email is the best method!

Notice to creditors usually cost around $275 to file with publication at the time of this article.
Notice to creditors must be published once a week for four (4) consecutive weeks
The personal representative must submit to the court:
- Notarized affidavit provided and signed by newspaper
- Notice to creditors (AOC-E-307) signed by you
- Must remain open until 90 days after first run
- Respond to claims by priority listing
